What these terms cover

These terms of use apply to the use of the Cyravo service unless otherwise agreed in writing with a customer, subscriber or another contracting party.

By using the service, the user commits to following these terms as well as organization-specific instructions, safety requirements and usage restrictions related to the service. At the current stage, the underlying learning environment and first core course in use is Cyravo Core.

1. Scope and right to use

• the service provider is Calesta Digital Productions Oy, Business ID 3106764-6, Jakarlan puistokatu 17 B 13, 20460 Turku, Finland

• the terms apply, as relevant, to learner and administration use of the Cyravo service and the related support services
• the right to use the service is personal or organization-granted depending on how the service has been delivered
• the right to use may be granted to a learner, admin or another authorized person, and use may be suspended or terminated if the terms are violated or the basis for access no longer exists

2. User responsibilities

• the user is responsible for storing their credentials carefully and for not sharing them with third parties
• the user commits to using the service only for the permitted purpose and according to their organization's instructions
• the user may not attempt to disrupt the service, bypass usage restrictions or process another user's data without authorization

3. Service content, availability and changes

• the service content, user interface and features may change because of maintenance, development or security reasons
• the service provider aims to keep the service available but does not guarantee uninterrupted or error-free operation in every situation
• if preview or pilot content is used in the service, that must be communicated separately in the relevant view

4. Intellectual property rights and usage restrictions

• the service software, content, graphics, structure and other materials belong to their respective rights holders
• the content of the service may not be copied, distributed, modified or used for any purpose other than the permitted use without separate permission
• content provided by the customer or subscriber is subject to separately agreed rights and responsibilities where they differ from these general terms

5. Limitations of liability, support and contacts

• the service provider is liable only to the extent required by mandatory applicable law. The initial draft assumes indirect damages are excluded and potential compensation liability focuses primarily on direct damages.

• these terms are governed by Finnish law. Disputes are to be resolved primarily through negotiation and secondarily in the competent court of the service provider's domicile unless mandatory law provides otherwise.
